On 13 September 2024, judgment was handed down by the Western Cape High Court in Part A of the matter Scalabrini Centre of Cape Town and Another v Minister of Home Affairs and Others, Case No. 8684/2024. Scalabrini Centre of Cape Town was challenging the Minister of Home Affairs in respect of the practices relating to newcomer asylum-seekers and “good cause” interviews. On 13 September 2024, the court granted an interim order in Part A of the litigation, interdicting (stopping) Home Affairs from initiating any process to deport any foreign national present in the South Africa, if that person has indicated their intention of applying for asylum, until their asylum application is determined on the merits. This interdict will stand until the court has decided Part B of the matter.
