On 23 September 2019, the Western Cape High Court sitting as an Equality Court ruled that the Department of Correctional Services has unfairly discriminated against and harassed a transgender woman in a men’s prison. The case changed the way prisons and places of detention in South Africa must accommodate transgender detainees, and confirmed the constitutional duty of the state to respect, protect, and promote the rights of equality, dignity, and freedom of expression that all transgender people have under the law.
