In a landmark judgment, the Constitution Court ruled yesterday that the City of Joburg had to give temporary land to squatters evicted from empty land in Marlboro, but it also had to provide them with materials to rebuild their shacks. About 141 families were evicted earlier this year and moved to a nearby tented transit camp. The court ruled that should the two portions of land in Marlboro where the squatters were living not be sufficient for them, the city would have to identify additional land on which to relocate the remaining families.

Hot on the heels of their recent Constitutional Court triumph, Lawyers for Human Rights scored another victory in the Pretoria High Court last week in a case in which a group of families was seeking to establish permanent residency on a piece of land in Bronkhorstspruit. About 100 families, mostly farmworkers, have been sent from pillar to post in the past, as they have on numerous occasions been evicted from the land where they settled.

The South African Human Rights Commission has turned to the courts to stop the Department of Home Affairs from deporting 33 asylum seekers currently in detention in the country’s repatriation centre. The commission filed the urgent application in the Johannesburg High Court on Saturday morning, after it was informed that the detainees would be deported. The matter will be heard on Tuesday. The 33 are part of a group of 39 migrants who have been held at the Lindela Repatriation Centre.

Home Affairs officials should be held personally responsible for the department's failure to implement court orders, Lawyers for Human Rights (LHR) said. "The court should hold home affairs officials personally responsible for court orders that are not followed," said LHR attorney Thandeka Duma. Duma said home affairs routinely detained people improperly and fought efforts to get them released. She said this forced LHR to appeal to the courts, where they won about 95 percent of their cases.
